Probate is a legal process by which the Supreme Court validates a deceased person’s Will so that the executor can carry out the deceased persons wishes in their Will. A grant of probate is an official document that authorises the executor to do this.
An executor is the person nominated in the Will to administer your estate. They are responsible for paying any debts owing following your death and distributing your assets as recorded in your Will.
If you die without a will (‘intestate’) the next of kin or the person with the largest interest in your estate will have to apply to the Supreme Court for Letters of Administration to deal with your estate. Without a Will, the State will determine how your assets are divided according to its intestacy laws.
